Private Landlords Electrical Safety Standards

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020

The new regulations come into force for new tenancies on the first of July 2020 and for existing tenancies on the 1st April 2021.

The key points are as follows.

Electrical inspection & testing is to be carried out in accordance with the latest edition of the wiring regulations. BS 7671:2018 18th Edition. The intention is to identify areas of the installation that may be potentially unsafe to the occupants and to rectify them accordingly.

On completion of the inspection & testing an Electrical Installation Condition Reports must be issued by the contractor to the landlord or the person ordering the work, in which a number of codes may be apportioned to any observations made. Any observations with a code C1, C2 or FI will deem the electrical installation as unsatisfactory.

Any observations apportioned a code C1 (Danger Present) will require rectification without delay.

Any observations apportioned a code C2 (Potentially Dangerous) or FI (Further Investigation Required) will require rectification within 28 days

Any observations apportioned a code C3 will not deem the installation unsatisfactory but remedial works should be considered,

The report and any subsequent reports or certificates must be provided to the tenant within 28 days

If the local authority requests a copy of the report, this must be provided to them within 7 days.

There are fines of up to £30,000.00 that can be enforced for breaches of the regulations

It is the landlords responsibility to ensure that the company or person carrying out the inspection & testing works is competent. It is advised that competency can be proved by membership of an approved contractor scheme such as the NICEIC and for carrying out works under Part P of the Building Regulations.
